Purchase Terms: Business Agreement, Returns & Claims Policy, Warranty & Promises

Standard Business Agreement 2.0 for Markskydd i Väst AB. TempoTrax® Series.
Effective from 2015-01-22 until further notice.

Agreement Acceptance
The buyer agrees to this contract upon receipt of an order confirmation, either via accepted quotation, email, or verbal order.

Agreement Between Buyer and Seller (Markskydd i Väst AB)
Delivery of plastic sheets within the agreed time and place. Unloading is not included and is normally the buyer’s responsibility.
Phone notification is not included. The price of the goods is according to the current price list or as agreed upon/quoted. Payment is due within 30 days from the placed order. The seller aims to deliver within 2-4 days if the item is in stock:
(For delivery time & terms, see above under the heading “Delivery Time”). However, this cannot be guaranteed by the seller as the third party, in this case, the transport provider, is responsible for delivery. Compensation is not provided for delays up to seven days beyond the stated timeframe. In the event of a longer delay, if not specified at the time of order, a potential price reduction may be discussed.
Risk passes to the buyer when the goods are delivered according to the agreement.

Product Usage and Warranty Limitations
TempoTrax® is a trademark. The product is an extruded (and molded version) plastic sheet marketed as ground protection. While the product has been shown through use and testing to be suitable and resistant to weight and wear, this is not to be confused with a guarantee of durability. The buyer must use common sense in assessing each use case. Since the product is a plastic sheet, it is essential to judge its use accordingly. Plastic expands in heat and stiffens in cold, potentially causing cracks under pressure. The combination of uneven surfaces, freezing temperatures, and weights over 100 kg increases the likelihood of plastic cracking.

Service and Return Policy
As a service, Markskydd i Väst AB offers customers the right to cancel the purchase if, upon first use, they find the product unsuitable for their purpose. The return policy applies to unused items only. Used items are not eligible for replacement. If more than one item (e.g., one plastic sheet) proves unsuitable and cracks or breaks, the buyer forfeits the right to return, as the first incident should indicate the product’s unsuitability.

Statements and Marketing
“Ground protection” is a broad term for various products aimed at protecting surfaces from damage. The degree of protection a product offers depends on numerous factors, making it impossible for Markskydd i Väst AB to guarantee protection levels. Statements such as “up to XX tons” are based on previous use and controlled testing environments (e.g., pressure on LDPE, HDPE on a stable, flat surface in a closed chamber). These are not guarantees or responsibilities taken by Markskydd i Väst AB. Buyers must assess the suitability of the product for their specific needs.

All claims from Markskydd i Väst AB regarding load capacity, durability, etc., should be viewed as examples and recommendations. We cannot account for on-site conditions, and it is always up to the customer to use common sense and evaluate early whether the product is suitable. Mark protection mats are to be regarded as consumables.

Product Defects and Remedies
If a product is defective and the issue is not due to the buyer’s actions, the buyer may demand rectification, replacement, or a price reduction. If the issue is significant, the buyer may cancel the purchase.

Inspection
The buyer must inspect the product as soon as reasonably possible, and no later than 20 days from receipt. If the buyer changes the delivery destination while the product is in transit or sends it further without sufficient time to inspect it, the inspection can be postponed until it reaches the new destination.

Claims
The buyer must notify the seller of any defects within a reasonable time after discovering them. Claims made after 20 days of receipt are void.

Rental Providers
If rental providers wish to make a claim, they must provide a truthful account of their rental income from the product. The seller reserves the right to a portion of these earnings if a replacement is provided. Used rental products may only be returned if rented once. Heavily rented products lose their right to claims.

Price Reduction and Cancellation
Price reductions must reflect the relationship between the reduced and agreed-upon price at the time of delivery. Purchases can only be canceled for significant breaches of the contract. The buyer cannot cancel without notifying the seller within a reasonable time (within 20 days of receipt or within the time specified for rectification or replacement).

Buyer’s Responsibility
The buyer must inspect and care for the product following the guidelines provided. Damage from third-party use, such as rental, negates the right to claim.

Examples of Specific Product Use

Returns and Cancellations
If more than one mat cracks, the purchase is considered complete, and the right to cancel is forfeited. However, unused mats may be returned within 7 days after receiving approval, with the buyer covering transport costs.

Right to Return
For full returns (complete orders), the buyer bears all transport costs and a 399 SEK administration fee. This right applies for 7 days from the placed order. Customers are responsible for proper packaging and loading of returned goods.

Summary
Some products may not fit all purposes or conditions. It is important to evaluate the product within 20 days of receipt to ensure it suits your needs. Ground protection mats should be viewed as consumables.

Warranty
No warranties are currently offered for the TempoTrax® series.

All claims regarding load capacity, durability, etc., are recommendations, and buyers should evaluate the suitability of the product for their specific conditions.
